NEW YORK — A federal appeals court in New York is considering whether to strike down an Arkansas law requiring women seeking abortions to undergo an ultrasound in the waiting room.
Lawyers for the state argued Tuesday that the law violates a woman’s constitutional right to privacy.
In a court filing, lawyers for the Arkansas Attorney General’s Office said that the ultrasound would be too invasive, and that the state had an interest in protecting the public health.
The U.S. Supreme Court has yet to rule on the legality of the Arkansas law.
It was struck down in April by the U.C.L.A. College of Medicine.
The Arkansas law was challenged in the U,S.
Court of Appeals for the 4th Circuit.
A panel of three judges on the court upheld the law, but only partially.
The appeals court later sided with the state and dismissed the case.
